Crime always develops, along with human civilization and technological advances. In dealing with this, the criminal law should consider several aspects, so that it can bring benefits to all parties. One of the factors for the increase in prison occupants is due to the policy formulation of regulations in assessing criminal acts. This study focuses on police policies in realizing Justice for the community at the investigative level. This type of research is doctrinal, using qualitative data in the form of rules and documents—data obtained by tracing, reviewing and examining general secondary data. Then the data is synchronized to find inconsistencies by analyzing the logic of thinking deductively. Research yields the result that, so, is a shift from penalization to non-penalties because criminal law does not always
lead to imprisonment of the perpetrators of criminal acts and other parties that need attention. This concept is based on the Head of Police Regulation No. 6/2019 and circular letter No. SE / 8 / VII / 2018. Limitation on the types of criminal acts that can be resolved at the investigation level gives its impact in criminal law enforcement. This situation carried out to maintain and prioritize Justice for perpetrators and victims, otherwise known as a balance of Justice. Limitations on the types of crimes that can be solved at the level of investigation give their concept in the enforcement of criminal law. This situation is done to maintain and uphold Justice for the perpetrators and victims or known by the balance of Justice.
