Penelitian ini bertujuan untuk mengetahui faktor-faktor penyebab terjadinya tindak
pidana hak cipta karya sinematografi pada situs ilegal oleh mahasiswa Fakultas
Hukum Universitas Borneo Tarakan. Serta untuk mengetahui hambatan penegakan
hukum terhadap tindak pidana hak cipta karya sinematografi pada situs ilegal yang
tidak ditindak hingga saat ini. Seluruh data yang diperoleh penulis dalam penelitian
ini dianalisis dengan menggunakan teknik analisis kuantitatif. Teknik pengumpulan
data dilakukan melalui kuesioner dan wawancara kepada responden sekaligus
narasumber yang berkaitan dengan masalah atau isi hukum dalam penelitian. Jenis
dan sumber data yang digunakan yaitu data primer yang diperoleh di lapangan dan
data sekunder dari penelitian kepustakaan berupa bahan-bahan tertulis yang
berkaitan dengan masalah (isu hukum) yang akan dibahas dalam penelitian. Pada
penelitian ini, penulis memilih lokasi penelitian di Fakultas Hukum Universitas
Borneo Tarakan. Jenis penelitian yang digunakan adalah tipe penelitian hukum
empiris. Berdasarkan data hasil penelitian yang diperoleh, penulis berkesimpulan
bahwa faktor-faktor penyebab terjadinya tindak pidana hak cipta karya
sinematografi pada situs ilegal oleh mahasiswa Fakultas Hukum Universitas
Borneo Tarakan yaitu faktor ekonomi, faktor kemudahan akses, faktor ketersediaan
film, faktor kualitas dan faktor waktu rilis; bahwa hambatan penegakan hukum
terhadap tindak pidana hak cipta karya sinematografi pada situs ilegal yang tidak
ditindak hingga saat ini terdiri atas 3, yaitu perkembangan teknologi yang
mempermudah pelaku untuk melakukan aksinya, sumber daya manusia dalam
aparat penegak hukum yang tidak sebanding dengan banyaknya kasus yang terjadi,
serta kesadaran atau pengetahuan masyarakat yang masih sangat rendah mengenai
hak cipta.

The purpose of this study was to identify the elements that led to students at the University of Borneo Tarakan’s Faculty of Law committing copyright violations against cinematographic works on unlawful websites and to identify the barriers that law enforcement faced in preventing copyright violations of cinematographic works on illicit websites that have not yet resulted in prosecution. Quantitative analytic techniques were used to examine all of the data that the researcher collected for this study. Questionnaires and interviews with respondents, as well as materials pertaining to the issue or legal content of the study, were used as data collection methods. The types and sources of data used were primary data obtained in the field and secondary data from library research in the form of written materials related to the problems (legal issues) that were discussed in the study. In this study, the researcher chose the location of the study at the Faculty of Law, University of Borneo Tarakan. The type of research used was the empirical legal research type. The researcher noted the following conclusions from the research data: economic factors, ease of access factors, film availability factors, quality factors, and release time factors were the factors that led to copyright crimes against cinematographic works on illegal sites by students of the Faculty of Law, University of Borneo Tarakan. The researcher also found that there were three main obstacles to law enforcement against criminal acts of copyright of cinematographic works on illegal sites that have not yet been prosecuted: technological advancements that facilitated the perpetrators’s actions, human resources in law enforcement officers that were not comparable with the number of cases that occured, and public awareness or knowledge about copyright that is still very low.
