Abstract
Hak Milik Atas Tanah Sangat Penting Bagi Negara, Bangsa Dan Rakyat Indonesia Sebagai Masyarakat Agraris Yang Sedang Membangun. Hak Milik Adalah Hak Turun Temurun, Terkuat Dan Terpenuh Yang Dapat Dipunyai Orang Atas Tanah Dengan Mengingat Ketentuan Dalam Pasal 6 UUPA. Di Kecamatan Tulin Onsoi Terdapat Masyarakat Yang Memiliki Perkebunan Kelapa Sawit, Namun Masih Memiliki Alas Hak Berupa Surat Tanah Yang Di Keluarkan Oleh Kantor Desa Dan Kantor Kecamatan. Berdasarkan Penjelasan Diatas Mengenai Hak Pemilikan Lahan Dan Masyarakat Pemilik Kebun Kelapa Sawit Di Kecamatan Tulin Onsoi. Maka Peneliti Ingin Menjawab Permasalahan Mengenai Hak Kepemilikan Lahan Perkebunan Kelapa Sawit Di Kecamatan Tulin Onsoi Kabupaten Nunukan. Penelitian Ini Bertujuan Untuk 1) Mengetahui Hak Kepemilikan Lahan Perkebunan Kelapa Sawit Berdasarkan Perundang-Undangan. 2) Mengetahui Fakta Hak Kepemilikan Lahan Perkebunan Kelapa Sawit Di Kecamatan Tulin Onsoi Kabupaten Nunukan. 3) Mengetahui Kesesuaian Antara Perundang-Undagan Dengan Fakta Di Kecamatan Tulin Onsoi Kabupaten Nunukan. Alat Analisis Yang Digunakan Adalah Analisis Isi Kualitatif Dan Analisis Deskriptif Kualitatif. Hasil Yang Diperoleh, Hak Pemilikan Perkebunan Berdasarkan Peraturan Perundang Undangan Dapat Berupa: 1) Hak Milik. 2) Hak Guna Usaha. 3) Hak Pakai. 4) Hak Ulayat. Adapun Hak Milik Dapat Dibuktikan Dengan Sertifikat Sebagai Alat Bukti Kepemilikan Suatu Hak Atas Tanah Yang Bersangkutan. Hak Pemilikan Lahan Perkebunan Kelapa Sawit Berdasarkan Fakta Berupa: 1) Surat Keterangan Penguasaan Tanah (SPPT). 2) Surat Keterangan Pelepasan Penguasaan Dan Pemilik Tanah Bangunan / Tanaman Diatas Tanah Negara. 3) Hak Milik (Sertifikat). Tidak Adanya Kesesuaian Hak Pemilikan Antara Peraturan Perundang-Undangan Dengan Fakta. Dikarnakan Hak Pemilikan Berasarkan Fakta Masih 34,4% Masyarakat Yang Memiliki Hak Milik Berupa Sertifikat. Implikasi Dari Hasil Penelitian Ini Adalah Perlunya Kebikajan Percepatan Sertifikasi Lahan Perkebunan Kelapa Sawit Di Kecamatan Tulin Onsoi, Sebagaimana Di Atur Dalam Peraturan Menteri ATR/Kepala BPN Nomor 35 Tahun 2016 Tentang Percepatan Pelaksanaan Pendaftaran Tanah Sistematis Lengkap.
Property Rights On Land Are Very Important For The State, Nation And People Of Indonesia As A Developing Agrarian Society. Ownership Rights Are Inherited, Strongest And Most Fulfilled Rights That Can Be Owned By People On Land, Bearing In Mind The Provisions In Article 6 Of The UUPA. In Tulin Onsoi Subdistrict There Are People Who Have Oil Palm Plantations, But Still Have The Right To Form In The Form Of Land Certificates Issued By The Village Office And The Subdistrict Office. Based On The Explanation Above Regarding Of The Land Ownership Rights And Community Owners Of Oil Palm Plantations In Tulin Onsoi Subdistrict. The Researcher Wants To Answer The Problems Regarding The Ownership Rights Of Oil Palm Plantations In Tulin Onsoi Subdistrict, Nunukan Regency. This Study Aims To 1) Find Out The Ownership Rights Of Oil Palm Plantations Based On Legislation. 2) Knowing The Fact Of Ownership Rights Of Oil Palm Plantations In Tulin Onsoi Subdistrict, Nunukan Regency. 3) Knowing The Suitability Between The Legislation And Facts In Tulin Onsoi Subdistrict, Nunukan Regency. The Analytical Tool Used Is Qualitative Content Analysis And Qualitative Descriptive Analysis. The Results Obtained, The Right Of Plantation Ownership Based On The Invitation Law Can Be In The Form Of: 1) Ownership Rights. 2) Business Use Rights. 3) Right To Use. 4) Customary Rights. The Ownership Rights Can Be Proven With A Certificate As A Proof Of Ownership Of A Land Right In Question. Ownership Rights Of Oil Palm Plantation Land Based On Facts In The Form Of: 1) Land Acquisition Certificate (SPPT). 2) Certificate Of Release Of Control And Owner Of Building Land / Plant On State Land. 3) Ownership Rights (Certificates). There Is No Suitability Of Ownership Rights Between The Legislation Rules And The Facts. It Is Said That The Ownership Rights Are Based On The Fact That 34.4% Of The People Have Ownership Rights In The Form Of Certificates. The Implication Of The Results Of This Study Is The Need For Wisdom To Accelerate Certification Of Oil Palm Plantations In Tulin Onsoi Subdistrict, As Regulated In The ATR Ministerial Regulation / Head Of BPN Number 35 Of 2016 Concerning Acceleration Of Complete Systematic Land Registration.
